X’s comments highlight serious concerns regarding the need for protection of free expression and fair enforcement in Brazil, impacting US digital service providers and warranting scrutiny under Section 301.

➡️ X has operated in Brazil since 2012. It is home to one of our largest user bases. But recent court rulings are undermining the 2014 Marco Civil da Internet (MCI), which protected freedom of expression, privacy, and intermediary liability. X outlined in our comments submitted to USTR that these new court decisions, which overrule significant aspects of the MCI, threaten freedom of expression as well as US digital trade.

➡️ Since 2020, Brazil's STF and Electoral Court—both under Justice Alexandre de Moraes—have issued secret orders for X to remove users, such as politicians, journalists, and even some US individuals. The decision was handed down in a monocratic ruling regarding the Mariana Agreement, but with a clear signal against the application of the Magnitsky Law in the country.

⚠️ Although the decision refers to a case concerning the agreement signed in the aftermath of the mining dam disaster, Dino stresses that the order applies “in these proceedings and in all others in which foreign jurisdiction – or any foreign state body – seeks to impose, within national territory, unilateral acts over the authority of Brazil’s sovereign institutions."

“It is forbidden to enforce impositions, restrictions of rights, or coercive instruments carried out by legal entities incorporated under Brazilian law and headquartered and managed in the country, as well as those with branches or any professional, commercial, or brokerage activity in the Brazilian market, arising from determinations contained in unilateral foreign acts,” the minister wrote in his ruling.

🇦🇷🌹 — Cristina Kirchner fails to comply with order to pay US$ 500 million to the court: the deadline for payment imposed by Argentina’s Federal Oral Court in the so-called Vialidad Case has expired. According to the Argentine newspaper Clarín, none of the nine convicts — including former president Cristina Kirchner — made the deposit.

⛓ The court order was issued as part of the restitution of damages resulting from a corruption conviction. Judge Jorge Gorini, responsible for the case, is authorized to initiate the asset execution process. Kirchner had requested the suspension of this stage and contested the officially calculated amount.

⚖️ With the failure to comply with the order, the next step will be the execution of assets already frozen until the amount stipulated in the case is reached. The judge also ordered the expansion of liens on properties “until covering the sum” and instructed that records be updated with the relevant agencies.

Maduro announces a "special offensive" to strengthen internal security in Venezuela

President Nicolás Maduro announced the start of a national security plan that will integrate civilian, military, and police forces in the 24 states and Caracas. The initiative aims to unite the "communal circuits" with the so-called "peace quadrants" to combat crime and strengthen citizen tranquility.

Maduro described this measure as a "new stage" of work that merges popular organization with police-military power. The peace quadrants, created in 2018, are zones between 2 and 5 kilometers with the presence of police and community leaders to prevent crime.

The announcement comes amid tensions with the United States, which raised the reward for Maduro's capture to 50 million dollars, accusing him of links to drug cartels. Foreign Minister Yván Gil denounced what he considers a "serious military threat" from the U.S. and called on the international community to reject these actions.

🇧🇷⚖️❗️🔎🙏 — Pastor Silas Malafaia, considered one of the country’s main religious leaders and the most influential pastor in Latin America, is under investigation by the Federal Police. 👮 Opened in May, the proceedings investigate actions against authorities, against the Supreme Federal Court, public officials, and attempts to obtain international sanctions against Brazil. According to Justice Alexandre de Moraes, the case’s rapporteur, these initiatives aimed to hinder the progress of the trial in which Jair Bolsonaro is a defendant for allegedly attempting a coup d’état.

💥 Malafaia was responsible for organizing the rally in support of Bolsonaro on August 3, during which the former president appeared in a video broadcast on third parties’ social media accounts, resulting in his house arrest the following day.
