🍿 How JAG can support civilian prosecutions and prosecute civilians:

Detailing / Secondment:
JAG officers can be detailed to DOJ as Special Assistant U.S. Attorneys (SAUSAs). In this capacity, they may prosecute civilian crimes in federal court, but only under DOJ authority. Common in cases involving crimes on military installations, procurement fraud, or national security.

Subject-Matter Expertise:
JAG attorneys often assist DOJ by providing military-specific expertise, e.g. classified info handling, chain-of-command issues, law of armed conflict, and especially in national security, classified information, or military operational contexts. They may serve as advisors, witnesses, or trial team members, but the DOJ retains prosecutorial authority.

Joint Task Forces:
In counterterrorism, espionage, or major fraud cases, JAG may be part of interagency task forces, working alongside DOJ, FBI, and intel agencies.

Investigative Support:
Military intelligence or JAG officers can provide classified analysis, chain-of-custody support, or testimony if military evidence is relevant.

Coordination:
If the conduct involves military secrets, installations, or communications, JAG may coordinate with the DOJ, FBI, and intelligence community.

🍿JAG’s prosecutorial jurasdiction is active duty, reservists, and retired military personnel. In addition to murder, theft, and SA, JAG prosecutes:

Article 94 – Mutiny or Sedition
Covers collective insurrection or attempts to overthrow lawful military authority. Sedition in the military sense is prosecutable by JAG.

Article 104 – Aiding the Enemy
Covers giving intelligence, supplies, or any kind of assistance to the enemy. Functionally overlaps with treason’s “adhering to enemies” clause.

Article 106a – Espionage
Covers spying and delivering defense information to a foreign power. Similar to treason if done for the enemy’s benefit.
